ACMA to appeal to High Court over 2Day case

Staff Writer

The ACMA have released this short statement on their website regarding the ACMA vs 2Day FM prank call saga.

"On 11 April 2014, the Australian Communications and Media Authority filed an application for special leave to appeal to the High Court from the decision of the Full Federal Court delivered on 14 March 2014.

"Pending resolution of that application, the ACMA will be making no further comment on the matter."

Last month 2Day FM won its appeal to suppress a report prepared by the ACMA over the incident from late 2012.

The full bench of the Federal Court overturned the decision made in November, setting aside the ACMA's finding that 2Day FM breached its licensing condition, and ordered the watchdog to pay the station's legal costs.

The court also ordered that the ACMA’s preliminary report was not to be made public.
