High Court appeal – 2Day Prank Call – it’s back on

The “Royal prank call” case is set to move to the nation’s highest court.

ACMA has approval to appeal the case against 2Day in the High court. 

Just when SCA thought it might have gone away back in March, when the Federal court  upheld 2Day FM’s argument that the ACMA did not have the authority to rule on whether they had broken the law by broadcasting a prank call to the Duchess of Cambridge back in December 2012. But  in April ACMA made their intentions clear to challenge the decision.

"All commercial radio and television broadcasters are very concerned that the Australian Communications and Media Authority decided several years ago to reverse its previous application of broadcasting law and to judge for itself the alleged criminal guilt of broadcasters rather than leaving that judgment to the courts based on proper evidence. Southern Cross Austereo considers that the unanimous decision of the Full Court of the Federal Court is completely correct and will continue to argue its position in the High Court.", SCA CEO Rhys Holleran said

On SCA’s part, the Federal Court ruling was part of the legal battle to suppress the ACMA report investigation but now the case moves to the highest court, SCA will again fight it’s position against the authority.
